Diritto e male : un'approssimazione

Abstract

La relazione tra diritto e male è per certi versi nota, giacché il diritto è speso concettualizzato come comando sostenuto dalla minaccia d'un male, la sanzione. O anche perché si afferma che il diritto è un rimedio al male provocato dalla violazione della legge. Per altri versi, per il suo lato più filosofico, è invece assai poco discussa. L'articolo si propone di presentare i vari modi in cui tale relazione tra diritto e male é stata tematizzata e può tematizzarsi a partire dalla controversia sulla definizione del male. Questa registrazione di usi e relazioni può condurci a qualche conclusione più generale sul concetto di diritto (ma anche forse sullo stesso concetto di male) e sui rischi morali dell'attività del giurista pratico.

The relationship between law and evil is to some extent well known, since law is often conceptualized as a command enforced by the threat of evil, i.e., by a sanction. Or because it is stated that law is a remedy to evil caused by violation of law. From the philosophical point of view, however, this relationship is rarely discussed. This paper aims at presenting the various ways in which this relationship between law and evil has been discussed and can be discussed starting from the controversy around the definition of evil. Such discussion on approaches and relations may lead us to some more general conclusions on the concept of law (but maybe also on the concept of evil itself) and on the ethical risks the practicing lawyer can incur.
