Abstract
La Constitution économique est un concept du droit de l’Union et un discours sur ce droit qui repose sur le projet d’établir une unité économique de l’Europe. À présent, ce discours doit s’adapter aux prétentions de l’Union de créer un espace commun pour les citoyens qui soit également de nature civile et sociale. Les structures et l’état du droit de l’Union, formés à la Constitution économique, permettent-ils de satisfaire ces prétentions ? Et qu’implique la création d’une « Constitution de citoyens » sur la manière d’opérer du droit européen ?
European Union Law is governed by the concept and the discourse on the Economic Constitution of Europe. A new reference has been introduced in the Lisbon Treaty to an area of Freedom, Security and Justice that the Union “shall offer to its citizens”. What are we to make of this reference ? Is Union Law adapted to this objective ? And what, if any, may be the contribution of EU Citizenship law to the legal doctrines and the constitutional discourse of the European Union ?
