Abstract
The chapter discusses the interaction of EU competition law and sector regulation in the media sector. Similar to other economic sectors, this industry has been subject to a concentration trend, justified by efficiency considerations. Media concentration, however, undermines the plurality of news outlets, thus undermining the quality of our democracy. The chapter argues that EU merger control cannot efficiently tackle media concentration due to its pure consumers’ welfare approach. In this regard, the chapter welcomes the introduction of a media pluralism test in Art. 22 of the recently adopted European Media Freedom Act (EMFA). The chapter reviews the past application of EU rules on merger control in the media sector and discusses the new challenges arising from the application of the media pluralism test in EMFA.
