Abstract
Repairing women's rights violations necessitates a gender-sensitive approach that not only acknowledges gendered harm but also strives to dismantle the underlying inequalities and discrimination underpinning the violations. The Cotton Field case, adjudicated by the InterAmerican Court of Human Rights (IACtHR) in 2009, stands as the sole instance of a regional court engaging with gender-sensitive reparations. This dissertation evaluates the IACtHR's application of a gender-sensitive approach to reparations post-Cotton Field, analyzing 32 judicial decisions from 2009 to 2022 through content analysis and legal interpretation. Findings reveal that the Court has consistently applied and broadened a gender-sensitive approach to reparations in cases of GBV, mainly through guarantees of non-repetition. However, such an approach was notably absent in reparations for cases of gross human rights violations in which both men and women were victims. A pivotal factor contributing to this discrepancy is the reparations requests from the Inter-American Commission and the representatives.
