dc.description.abstractDort wo die Medienfreiheit und Medienvielfalt unter Druck geraten, werden die Möglichkeiten von Unionsbürgern und -unternehmen beschnitten, sich aus unabhängigen Medien zu informieren. Die Meinungsbildungs- und Informationsfreiheit des Einzelnen ist aber darauf angewiesen, dass Mediendiensteanbieter von ihrer Medienfreiheit Gebrauch machen (können). Der Unionsgesetzgeber hat in Art. 3 des European Media Freedom Act (EMFA) dieses individuelle und gesellschaftliche Bedürfnis in eine justiziable Rechtsposition des Einzelnen gegossen. Die Verfasser stellen diese Konkretisierung der passiven Dienstleistungsfreiheit, ihre mögliche Reichweite und Ideen für ihre grundrechtliche Rückkoppelung an die Grundrechte-Charta vor.de
dc.description.abstractWhere media freedom and pluralism come under pressure, the ability of EU citizens and businesses to obtain information from independent media is being curtailed. However, the freedom of opinion-building and of information for individuals depends on media service providers’ making use of their media freedom and their ability to do so. The EU legislature has transformed in Article 3 of the European Media Freedom Act (EMFA) this personal and social need into a justiciable legal position for the individual. The authors present this concretization of the passive freedom to provide services, its potential scope and ideas on its connection to the fundamental rights of the Charter.en
