Comunità energetiche e fonti rinnovabili

Abstract

Energy communities dealing with renewable sources currently play a limited role in the European energy system. However, there is an increasing acknowledgement that they will represent an essential tool to involve citizens and foster the energy transition. The recent reform of European energy law recognizes such prominence and introduces new legal concepts with related rights and duties. Member states shall transpose and implement such regulation at the national level. The significant leeway that Member states benefit from suggests that the development of energy communities will be rather heterogeneous in the coming years and differ from country to country.

Le comunità energetiche a fonti rinnovabili occupano attualmente un ruolo secondario nel sistema energetico europeo, ma sono ritenute sempre più uno strumento fondamentale per coinvolgere i cittadini e facilitare la transizione energetica. La recente riforma del diritto dell’energia europeo ha riconosciuto tale importanza e introdotto una serie di nuove categorie giuridiche con relativi diritti e obblighi. Gli Stati membri sono chiamati a trasporre tali disposizioni nei loro ordinamenti e a darne attuazione. L’ampio margine di discrezionalità di cui godono gli Stati lascia supporre che lo sviluppo delle comunità energetiche rimarrà piuttosto eterogeneo nei prossimi anni e cambierà da paese a paese.
