This legal comment takes a critical look at the CJEU's decision on the processing of personal data under the Passenger Name Records-Regulation (EU) 2016/679 (Case C-817/19). Whereas the collection, transfer, processing and retention of third country nationals' PNR data was considered proportionate, the Court found a violation of Art. 7 and 9 of the Charter of Fundamental Rights especially if domestic legislation extended the application of the PNR system to all transport operations within the EU, thus limiting also the freedom of movement within the EU.
