With its novel approach of combining state aid, competition, public procurement and external trade law, the EU Foreign Subsidies Regulation (FSR) aims to achieve a level playing field on the internal market and to export the European framework abroad. However, frictions arise. This article contextualises the FSR as part of the EU’s trade policy response to large-scale subsidies programs worldwide in its EU and international law framework.
