The chapter describes the legal resources offered by the European Treaties to the EU’s institutions for developing a cultural policy. The main legal basis for this cultural policy is Article 167 TFEU, which allows the EU to do certain things and prohibits other things. However, this primary cultural policy competence is complemented by ancillary competences in other parts of the Treaties. The discussion of the legal resources is preceded, and put in context, by a summary presentation of the main roles played by the European Union in the cultural policy domain, and the main policy aims that the Union is mandated to pursue.
