This article discusses data ownership and access rights in the work of the European Food Safety Authority (EFSA). The Authority collects various types of data from multiple sources and uses them in its daily work. The vast majority of these data are owned by third parties. The use and access rights of EFSA as regards third-party data are governed by a patchwork of statutory and contractual obligations, while public release of data requires a careful assessment of the obligation to protect public health versus the potential liability of EFSA for damage to commercial interests of third parties.
