Restructuration et comité d’entreprise européen

Abstract

Cet article essaie de préciser l’action du comité d’entreprise européen dans le cadre actuel des restructurations qui ont lieu dans l’Union Européenne, en raison du caractère transnationale des entreprises . Le comité d’entreprise européen a une faible marge de manœuvre en période de crise . cependant on voit dans certaines conditions favorables son rôle se développer dans plusieurs directions ( informations transnationales, actions face aux acteurs institutionnels et politiques) . Il acquiert progressivement un rôle plus important quand il s’agit de négocier des règles relatives aux restructurations en intervenant comme acteur ou comme « facilitateur » aux côtés des organisations syndicales européennes et internationales ( ACI-Accord cadre Internationaux ). Apparaît donc progressivement une nouvelle architecture de l’action des acteurs sociaux face aux restructurations . This paper tries to precise the role of the European Work Council in tranantional firms’ restructurings in the EU.The European Work Council has a weak position during the crisis but in favourable conditions can have a new role in different directions ( transnational informations, action with politics and EU institutions) . It gets slowly a more important role as collective actors inside a new specific collective bargaining or as complete actor or as “facilitator” , with European and international trade unions ( IFA-international framework Agreements)). Then, an new architecture for collective bargaining is emerging in the field of restructurings in Europe .
