dc.description.abstractOn 9 October 2005, almost unnoticed, the Statute of the Iraqi Special Tribunal (IST) was amended and the Tribunal was changed into the Iraqi High Tribunal (IHT). These amendments introduced into the legal and procedural system of the Tribunal significant changes that directly impacted upon the functioning of the Tribunal as well as upon some of the most fundamental rights of the defendants. Although statutory amendments are not per se improper, those introduced in the Statute of the Iraqi Tribunal are likely to further undermine the credibility of this institution.
