Article 78 TFEU and the way to a common European policy in the field of asylum

Abstract

This chapter looks at Art. 78 TFEU, the legal basis in the primary law of the EU for a Common European Asylum Policy, and provides a brief historic overview of the development of the EU competences in this field. The Common European Asylum System (CEAS) was gradually achieved in different phases of legislative harmonisation, aiming at common standards and procedures.
